TERMS AND CONDITIONS
Once allotted and agreement signed, price will be firm.
On allotment of plot, two agreements will be executed between the builder and the client; one for the purchase of the allotted plot and another for the construction of residential building in the said plot according to the plan and design given and agreed to the buyer.
- The sale deed for the land will be registered in the name of the client by the landowner on receipt of the payment as per the agreements.
- Possession of residential building shall be handed over to the clients on settling of all the dues to the builder.
- In addition to the plot area, the buyer is entitled to get proportionate share in common area.
- The plot area is inclusive of proportionate share of common areas.
- Cost of stamp paper, Registration charges, legal, miscellaneous expenses and subsequent claim by the department, if any, in connection with the registration of land and undivided share in land are to be borne by the purchaser.
- Other expenses to be borne by the client include sales tax on works contract or VAT as applicable, all local taxes, service taxes, construction workers welfare fund, Kerala building tax, Provident fund or similar social security contributions, if any applicable or made applicable during the period of the contract or after its completion in relation to the project, other statutory payments in respect of the construction work carried out, KSEB deposit and service connection expenses, water connection charges from common well, monthly maintenance expenses/ advance for the common area and the charges for extra work, if any,.
- In case payments are not made as per agreement signed, the builder reserves the right to cancel the allotment, in which case, refund to the client will be made only after re-allotting the unit to another party and such refund shall be without any interest and subject to the deductions of expenses and damages.
- Maintenance and usage charges of common facilities are to be met by the homeowners. Membership in the owner’s association is compulsory and not optional.
